Renting a Room or a Whole Flat: HDB’s Rules on Occupancy and Minimum Stays

Renting in an HDB flat, whether a single room or the whole home, comes with two rules that never bend: the rental must last at least six months, and the owner must have HDB’s approval before you move in. Short stays by the night or week are not allowed at all. How many people can live there depends on the flat type: four for 1- and 2-room flats, six for 3-room flats, and eight for 4-room and bigger flats under a temporary relaxation that HDB and URA have extended to 31 December 2028. Those caps count everyone in the flat, owners included. Condos and other private homes follow URA’s rules instead: a minimum stay of three consecutive months and a cap of six unrelated people, or eight in registered units of 90 sqm and above.

Room or whole flat: what is the difference?

When you rent a bedroom, the owner and everyone listed on the flat must keep living there with you. HDB’s own words: owners and authorised occupiers must continue to live in the flat during the rental. That is why room rentals are open to more owners, including Permanent Residents, owners still serving their Minimum Occupation Period, and owners of Plus and Prime flats, as long as the flat is a 3-room or bigger. Owners of 1- and 2-room flats cannot rent out bedrooms.

When you rent the whole flat, the owner moves out and the bar is higher. The owner must be a Singapore Citizen, the flat must have completed its five-year Minimum Occupation Period, and it must be a Standard flat; Plus and Prime flats cannot be rented out whole. Whole-flat rentals in a block or neighbourhood are also subject to HDB’s Non-Citizen Quota, which can limit who the owner may take on as tenants.

How many people can live in the flat?

HDB’s occupancy cap counts owners, authorised occupiers and tenants together, and it applies even if the tenants are one family. In January 2024 the government temporarily raised the cap for 4-room and bigger HDB flats, and for private homes of at least 90 sqm, from six to eight people. In January 2026 HDB and URA extended that relaxation until 31 December 2028, after which the cap for these flats is due to return to six unless the rules change again.

For private homes, URA counts unrelated persons, meaning anyone outside the same family unit, and does not count domestic helpers. The higher cap of eight only applies if the owner has registered the unit with URA.

Who is allowed to be a tenant?

HDB tenants can be Singapore Citizens, Permanent Residents, or foreigners holding an Employment Pass, S Pass, Work Permit, Student Pass, Dependant Pass or Long-Term Social Visit Pass that is valid for at least six months. Work Permit holders in the construction, manufacturing, marine and process sectors must be Malaysian to rent an HDB flat. Tourists cannot rent at all. Tenants generally cannot own another HDB flat or be public rental tenants at the same time, with limited exceptions.

Checking a rental before you sign

  1. Ask the owner or agent whether HDB approval has been obtained, or will be before your move-in date. Approval comes before the tenancy, not after.
  2. Count heads: add up owners, family members and every tenant, and compare with the cap for that flat type.
  3. Check that the term is at least six months (HDB) or three consecutive months (private). Anything shorter is not allowed.
  4. If you are renting a room, confirm the owner lives there. A “room” in a flat with no owner present is a red flag.
  5. If an agent is involved, check their registration on CEA’s public register, and make sure rental stamp duty is paid on the signed agreement.

The stakes are real for owners: in a 2022 parliamentary answer, the Ministry of National Development said unauthorised renting out can draw a warning, a financial penalty of up to $50,000, or, in serious cases, HDB compulsorily acquiring the flat. A tenant in an unapproved rental can lose the home at short notice.

Treat HDB approval and the six-month minimum as non-negotiable, because they are. A cheap room offered for a few weeks, or a whole flat with ten people in it, is not a bargain; it is a rental that can end without warning. Ask for proof of approval, count the occupants, read the term, and you will rent with a quiet mind.

Questions people ask

Can I rent an HDB room for just one or two months?

No. HDB requires every rental of a flat or bedroom to last at least six months. Short-term stays are not allowed, whatever the platform.

Does the occupancy cap include the owner’s family?

Yes. HDB counts owners, authorised occupiers and tenants together. A 4-room flat with a family of four can take at most four tenants under today’s cap of eight.

Can a PR owner rent me a room?

Yes, if the flat is 3-room or bigger and the owner has HDB’s approval. PR owners cannot rent out the whole flat.

Is the three-month rule for condos the same as HDB’s?

No. URA sets a minimum stay of three consecutive months for private homes; HDB’s minimum is six months. Daily or weekly rentals are banned in both.
